Why the Makers of Fen-Phen Were Wrong
Wyeth and American Home Products were the primary manufacturers of Fen-Phen, which later was linked to Primary Pulmonary Hypertension and heart valve problems. These two companies are liable for injuries relating to their drugs for a variety of reasons.
For starters, the drug’s promotional materials and marketing scheme were intended and designed to create the impression that the use of fen-phen was safe and also an effective weight loss method. Finally, the makers of Fen-Phen did not follow the recommendations of the FDA and their own staffs to provide a highlighted “black box” warning on the label of fen-phen. This warning would inform consumers of the PPH risk. By not including the label, millions of consumers were exposed to the risk of a fatal illness.
